1/24/2012 I had conducted a complaint investigation here on 4JAN12 which alleged unlawful appliance demanufacturing. At that time the facility was going out of business and I told operator Pam Julien not to accept any more appliances if their business was not viable. This current complaint alleges that appliances were mishandled on 9JAN12. I went to this facility on 24JAN12 and noted two conspicuous signs: “Under New Ownership as of January 17” and “We Do Not Accept Appliances at This Time”. I spoke with Travis Bell who stated that his group had assumed ownership on 17JAN12 and he had no knowledge of anything that might have occurred on 9JAN12. I looked around the facility and saw only a couple appliances – two freezers. Mr. Bell stated that they were there when he took over the business. We discussed appliances and Mr. Bell indicated that an affiliated business, Bell Salvage of Ames, had a demanufacturing permit and they intended to demanufacture appliances at Rowan under that permit when they got their salvage license. I advised Mr. Bell that this approach was not allowed, because the permit for the Ames facility would allow demanufacturing at Rowan only if it was a “mobile” demanufacturing permit and I was reasonably sure that there were no active mobile demanufacturing permits in Iowa at this time. I spent some time going through the requirements and steps for this facility to obtain a demanufacturing permit, and I will send Mr. Bell the appliance demanufacturing permit application materials. The previous owner had a storm water permit, but Mr. Bell’s current business is an entity distinct from that which holds the permit, so they will need to transfer the storm water permit as well.
