11/3/2005 I recently conducted a manure management plan (MMP) and land application records inspection at your hog confinement site located in Section 23 Richland Township Carroll County Iowa. During the inspection I observed large holes in the concrete wall of both buildings. Evidence of manure seeping out of the buildings into the nearby farm field was observed. This is a violation of Subrule 567 IAC 65.2(3) (enclosed) Which states that the minimum level of manure control for a confinement feeding operation shall be the retention of all manure produced in the confinement enclosures between periods of manure application.You stated that the pipe that connects the shallow pits of your buildings to your earthen manure storage structure became plugged. You also stated that you deliberately created holes in the concrete walls of both buildings. During the inspection I required that the concrete be repaired to prevent further manure spills. We agreed that this would be completed immediately and no later than October 1 2005.On November 3 2005 I conducted a follow-up visit to your site. During that visit I verified that the concrete has not been repaired. Failure to repair the concrete by November 15 2005 will result in a referral to the DNR legal section in Des Moines where a monetary penalty may result AfoLOADInsp-2-07/20/2010
