7/20/2010	On January 10 2008 I visited your open cattle feedlot located in Section 25 Saint Johns Township Harrison County Iowa. The purpose of the visit was to observe the routine operation and maintenance of the feedlot. A copy of the inspection report is enclosed for your reference. Several deficiencies were observed during this visit. A list of requirements can be found in the report. As the report states the National Pollution Discharge Elimination System (NPDES) permit for this facility has expired. However the permit has not been renewed for failure on your part to address the department’s concerns. I have also enclosed a letter sent to you on May 25 2005 addressing the department’s concerns and requiring that a written response be submitted before the permit could be renewed. Your nutrient management plan (NMP) states you have a head capacity of 1300 head. Additionally it appears as if an expansion has occurred to the north of the existing feedlot pens. In accordance with Subrule 567 IAC 65.101(3) (enclosed) an open feedlot operation which has an animal unit capacity of 1000 animal units or more shall not discharge manure process wastewater settled open feedlot effluent settleable solids or open feedlot effluent from an open feedlot operation structure or production area into any waters of the Unit States unless the discharge is pursuant to an NPDES permit. It is required that a written response addressing all of the department’s concerns and requirements listed in the report be submitted to this office no later than May 1 2008.
