3/21/2013 DNR’s Alex Moon, Mike Smith and I met with the NCIRSWA Board on March 20, 2013. There were three reasons DNR requested the meeting: 1 - To urge NCIRSWA to hasten their design of the proposed landfill expansion because DNR is concerned they will be out of airspace before an expansion is designed, permitted and constructed. 2 - To clarify whether NCIRSWA is or is not disposing of solid wate over an unlined area. DNR has made two written inquiries into this issue with no response. 3 - To hear NCIRSWA’s response to the DNR’s 7JAN13 notice that they have been referred to the Iowa Attorney General for chronic, ongoing violations of the Iowa Administrative Code. Prior to the meeting, DNR drove by the landfill and noted that daily cover was not in place at 5:15 PM, and that off site litter was unacceptable despite numerous NOVs and a specific directive to have all off site litter picked by February 28, 2013. DNR’s attendance at the meeting was not well publicized and there were only four Board members present, two short of a quorum. Chairman Troy Hassebrock was not present. The attending Board members were apparently not aware that the landfill was operating without a permit, that there was a potential for the landfill to run out of permitted capacity, that there were chronic ongoing compliance issues or that there was pending legal action. It was not immediately clear why repeated letters directed to the Board Chairman had not been provided to him or anyone else on the Board. DNR will attend the next Board meeting on April 17, 2013.
