6/27/2013 Visited site 6/27/13 ~ 9:15 a.m. after Lyndall Winter called 6/26 to indicate that more sediment had migrated across into his property. He also questioned the fill height and the current fill area. I observed that the temporary berm around the SE corner of the borrow area was blown out and sediment had migrated SE towards the rock (slag) at the fenceline. The rock had sediment in it, but I did not see sediment across the property line. However based on the area and conditions, sediment loaded water was likely discharged onto this property. The silt fence on the NE corner below the partially vegetated gully failed and was flat on the ground. It does not appear that it was trenched in when installed. Sediment was observed within the vegetation above, over, and beyond that silt fence. I contacted Laura and informed her of the failures. We discussed my findings and that even though these measures are temporary, something needs to be reinstalled. Permanent measures or solutuions need to be implemented by August 1 unless weather conditions do not allow. I told her that I need to be notified of progress. Laura indicated that she is confident that the elevation of the fill is not above limits in the permit. Regarding that issue I could not determine the exact elevation of the curent fill operation, but did note that they were working at the top of the current Phase (4), on the south side. BRIAN LEE
