8/21/2025 Lori McDaniel received a call from the Mr. Crees. His parents are Bill and Jeanette Crees. Lori sent the vm's to Jason Marcel, who sent them onto me. I spoke with Brent and Alison regarding the progress of AgriLand working with DNR. Here is the latest information regarding the matter: Brent conducted a complaint investigation (no. 34780) on March 17, 2025. He documented erosion and animal burrows along portions of the facilities retention basin. Also, he did not document water quality violations or signs that the water made it to the neighbors farm pond. At that time, Agriland advised Brent that it was planning to make the retention basin larger. Since then, Agriland has purchased more land, to make the basin larger. The Crees' shared with Brent they do not want their basin to get bigger. Suspense date for July 15, 2025. Then, on 08/14/25, the Crees' contacted Brent with the following: Dirt is being washed down the hill from Agriland's new stormwater basin and into their sediment basin. Brent contacted Jeff Miller, Agriland, who stated that while they were working on this construction, they unearthed a tile line, where water was flowing out, which caused sediment to flow on the Crees' property. Miller said they worked on the tile line to fix the issue. It has since been re-routed. Now, Agriland is looking to remove the dirt and seed the berm. With regards to 052311-MAC-1145 HSI report mentioned and the subsequent order that followed, below are excerpts from the resulting order. This is likely why Agriland is making the basin larger, i.e., due to the issues Brent found earlier this year and to ensure compliance with the order from ~15 years ago. In the end, after Agriland fixes their issues outlined in complaint no. 34780, finalizes their expansion and removes the soil, it might end up becoming an Individual Drainage Rights / civil matter between the two parties. For now, though, Agriland is still working on fixing the issue raised in the complaint. We continue to work with both parties and, specifically Agriland, to ensure compliance with stormwater regulations. JESSICA MONTANA
4/3/2025 As discussed, please ensure repairs to the basins are made, including a plan for dewatering the eastern most basin. Please contact me by July 15, 2024, documenting repairs were made. In the interim, ensure water quality violations do not occur. Also, the west retention basin must be monitored and dewatered to prevent any overflows until final controls are in place. ALISON MANZ
