8/9/2021 I investigated this complaint on June 25, 2021 I observed a large roll off full of garbage and a couple of roll offs with construction waste on your property. Troy and I discussed the nature of the complaint and he stated that the complainant had not paid their bill yet. Troy stated that if the solid waste bill remains unpaid that you would return the solid waste back to the property it originated from. I asked for a walk through of the property to verify the validity of the complaint. He initially said no, and I explained that I would return with a warrant and likely a law enforcement officer like the State Patrol. He said fine and we toured the property and I observed numerous roll-offs some full and some empty, several piles of construction and demolition waste on the north side of the property, a pile of tires on the south side, a few piles of fill material on the west side of the property. I did not see any evidence of open burning that had recently occurred. Troy asked if open burning of trees and landscape material was allowed to take place as part of a birthday party. I explained that as long as the tree material burnt in in compliance with the exemptions allowed (i.e. originated on the premises) and anything else would be likely be a violation of the Iowa Administrative Code, especially with all of the material maintained on the property. Troy pointed out that he doesn't agree with the Kurt's or the DNR's definition of solid waste. RYAN STOUDER
