7/9/2013 I investigated this complaint on 9JUL13. I went to the FMC landfill and spoke with Derrick Huffman and Jimmy Geertz, explained the complaint and showed them the complaint letter. Both denied the allegations and produced records showing that they had hauled numerous loads of leachate to the Osage POTW all throughout June. Mr. Geertz claimed that some specific phrases in the letter were commonly used by a former employee who was forced to resign within the last year. I inspected the area described in the complaint letter. The letter alleges that leachate was being pumped from the "lagoon overhead' into the tanker truck, which places the tanker at the leachate load out point. The letter further alleges that, simultaneously, the tanker had a drainage hose from the tanker to the “edge of the bank” where it then ran down the bank and into the “waterway”, which is the first of two stormwater sedimentation ponds. The leachate load out point is approximately 100' from the “edge of the bank” and approximately 200' from the “waterway”. The tanker discharge hose is approximately 16' long so, if the complaint was factual, an additional 84' +/- of discharge hose would have been required, and there should have been some evidence of leachate discharge along the ground surface from the “edge of the bank” into the pond. If the tanker had been drained using the 16’ tanker discharge hose, there should have been staining on the ground and the leachate would have run back into the leachate load out catch basin. There was no additional discharge hose in the area and Mr. Huffman stated that there was no hose on the property capable of meeting the alleged scenario. I found no evidence of erosion, stained soil or discolored vegetation attributable to the scenario in the complaint letter, and nothing to substantiate leachate dumping as described in the complaint letter.
