10/30/2015 I investigated this complaint on October 27, 2015. I first stopped and spoke with Mr. Beyer and he pointed out the land application fields and indicated that the application near his house was with a solid manure spreader. I explained that there is not a minimum separation distance requirement for land application of solid manure. I told him that I would contact the producer to confirm the type of manure and where it was originating. The second application area was adjacent to a slurry store across the section. I determined that the manure application occurring adjacent to Mr. Buyer's house was from an open feedlot and bedded barn owned by Joe Miller. There is no minimum required separation distance to residences for solid manure from an open feedlot or bedded barns. The application field was relatively flat and no runoff concerns were noted. This facility is a SAFO and not required to keep application records. The application near Spring Creek was from a second farm (first place directly west of Joe Miller on 2343 350th). This facility is owned by Loren Wagner. Mr. Wagner indicated that he applied feedlot runoff on the field adjacent to his slurry store. This field is within 200 ft. of Spring Creek in places; however, from aerial photos a vegetative buffer of greater than 50 feet exists along much the creek. Additionally, Mr. Wagner reported that he had incorporated the manure after the application. No violations were documented during this investigation. No further action required. JEREMY KLATT
