4/12/2017 I found no evidence to support the complaint that Daybreak had unlawfully discharged their wastewater lagoons, but today we received the MOR for March which covers the period when the alleged discharge occurred. I reviewed the MOR and found that all three cells increased in depth in a manner consistent with previous months, which strongly suggests that there was not an unlawful discharge as the complainant alleged. 3/17/2017 The complainant called today and asked what were the results from our investigation that they were unlawfully discharging wastewater into the creek. I explained that I had investigated and found no evidenvce this took place. I asked how he knew that they were discharging wastewater and he stated that it was obvious because he could see water running in the field. I suggested that it might have been snowmelt running n the field, but he stated that there was no snowmelt on the day he observed the running water. I asked him when he saw the water and he said he saw it the day before he made the complaint on March 8, so it was March 7th. I pulled up the weather for March 7 and it the temperature had been in the 50s on that day so I suggested there could well have been snow melt. We had a lengthy conversation about how he knew it was wastewater and no surface water and we always came back around that “it was obvious”. I eventually told Mr. Derscheid that, if he saw this again, and was sure that it was wastewater and not surface water, he should call me directly and we would discuss how he knew it was wastewater and not surface water. Later, I pulled up the most recent MOR which showed that the depth of the Cell 1 increased from 10.7’ to 11.1’ from the beginning of February to the end of February 2017. Cell 2 went from 10.2’ to 10.8’ and Cell 3 went from 13.0’ to 13.3’ in the same period. I will look at the lagoon elevation information when the March wastewater MOR comes in. DAVID MILLER
3/10/2017 I investigated this complaint on 10MAR17. It was below freezing today, and there was frozen snowmelt in the grass waterway, so there probably was running water when the complaint was made. I spoke with Daybreak’s Richard Kulow and Nick Wilson and explained the complaint. They stated that the complainant was disgruntled because he used to farm the ground that the wastewater is sprayed on, but he was hesitant to farm the ground after the bird flu incident. Daybreak just got another farmer and the complainant has been quite unpleasant since. I looked over the lagoon and spray field system and determined that it would be impossible for Daybreak to voluntarily discharge to the grass waterway. The only way the wastewater could get into the grass waterway was if the lagoons overtopped or there was a break in the line to the pivot sprayer, which would leak only when the pump was turned on. Mr. Kulow stated they have not run the pump since last fall. I recommend that we not investigate additional complaints from this complainant on this topic unless he states the specific reason why he believes it is wastewater that is discharging. DAVID MILLER
