2/15/2011 On February 11, 2011, Eric Wiklund and I (Miller) traveled to the Primera facility at 1260 Highway 18 East in Britt, Hancock County, Iowa and met with the Acting Plant Manager, Shane Bell at approximately 10:30 AM. The facility is an egg breaking and packaging plant. I notified Mr. Bell that the DNR had received an anonymous complaint alleging that egg crates and other materials were being burned at the Plant’s wastewater lagoon, located a few hundred yards south of the Plant. I asked Mr. Bell if they had burned there and he admitted they had. Mr. Bell accompanied us to the area of interest where we observed charred pallet remains and partially burned cardboard egg crates. I told Mr. Bell that the Complainant had asserted they burned about 3 times a week and Mr. Bell stated “that sounds about right” but he also indicated that it was periodic and related to whether their incoming egg shipments utilized cardboard packaging. I advised Mr. Bell that open burning was prohibited in the State of Iowa except under very specific circumstances, none of which applied in this case, therefore Primera had violated Rule 567 IAC 23.2(455B). I gave Mr. Bell a copy of this Rule and went over the key aspects with him, and Mr. Bell and stated that burning would cease. I advised Mr. Bell that Primera would receive a Notice of Violation which could possibly include enforcement and monetary penalty. DAVID MILLER
