1/1/2006 In January 2006 I conducted a complaint investigation at your facility. During the inspection I observed large holes in the concrete wall of both buildings. Evidence of manure seeping out of the buildings into the nearby farm field was also observed. It was required that the concrete be repaired to prevent further manure spills. During several follow-up visits to your site it appeared as if you tried using 2 x 4 pieces of wood to repair the concrete. However I sent you a letter on January 8 2008 asking you to notify this office as to how you repaired the concrete as 2 x 4 pieces of wood would likely not weather very well. I recently stopped at your confinement again and noticed that both buildings are leaking manure from the pit fans on the east side of the buildings. These are the same locations as previously documented. As you are aware this is a violation of Subrule 567 IAC 65.2(3) which states in part that the minimum level of manure control for a confinement feeding operation shall be the retention of all manure produced in the confinement enclosures between periods of manure application. This matter will likely be referred to the department’s legal section in Des Moines for enforcement action and a penalty.
