12/10/2024 On December 10, 2025 after checking with Ted Petersen, Dennis Thielen, Marlon Mueller, Eric Wicklund, and Kelli Book I sent Eldon McAfee the following reply: Hi Eldon, We have no problem granting a 40-day extension for your response in light of the review Grand River Cattle and Pinnacle are doing, and with the holiday season. I was looking at the calendar and 40-days would put the due date at January 19, 2025 which is a Sunday. and the following day January 20th is Martin Luther King, Jr. Day which is a state holiday. Let's make the due date for the response Tuesday, January 21, 2025. I am retiring at the end of this year. 12/10/2024 On December 10, 2024 I received the following email from Eldon McAfee with Brick Gentry, P.C.: Bill: I am assisting with responding to the Department’s Oct. 4, 2024, letter denying Grand River’s NPDES permit renewal application. I am working with the engineer, John George at Ag Engineering Associates, as well as Todd, Brian and Amber. John did not prepare the original design and we are sorting through the file to determine the appropriate options and response. To do that we need additional time and are requesting a 40-day extension of the Dec. 10 deadline in the Oct. 4 letter. We would have requested a 30-day extension but with the holidays, we assumed it may take more time than normal. Please let us know if you have any questions. Thank you. Eldon McAfee BILL GIBBONS
10/4/2024 On October 4, 2024 we sent a letter to Grand River Cattle Co., LLC regarding their application to renew the NPDES Permit. The letter explained the permit could not be reissued (renewed) as the site is currently configured. The letter asked for a response by December 10, 2024. Please see the attached letter. BILL GIBBONS
