I did a little more digging into the variance and although I cannot find an actual copy of the document, I did find something in our WSE database that identified a project number and a short sentence about the 200' legal control issue: W2004-270 Well Site Survey for ASR : It's @ Louis P. Moon GSR, Sw 1/4 Sec. 25, T79N, R26W. Well will be 2,700 feet deep. Variance for site separation distances/legal control. I also reviewed the site survey and it contained the following statements: Legal Control w/in 200 feet: Subparagraph 43.3(7)”b”(1), IAC requires that after a well site has received preliminary approval, the owner must submit proof of 200 ft. of legal control around the well site. The DMWW currently owns/controls 87% of the land within 200’ of the current placement plans. However, the placement plans include a small area to the south-southwest of the well within the 200’ zone of required control that the city does not own nor currently has legal control over. Mr. MCCleary and Mr. Corrigan indicated that due to current underground piping at the GSR site they don’t want to move the well any further east/northeast to meet the control requirement. A request for variance has been submitted. The concern would be adjoining property owners moving in sources of contamination. I have tried to put some information into the file so if this comes up again, we have documentation. The protocol looks fine and has been approved. Please keep it up to date as conditions warrant. 2/11/2021	Revised Turbidity Protocol Inbox Danley, Kyle Attachments Jan 28, 2021, 4:33 PM to Janet, Nathan Janet Attached is the revised turbidity protocol you requested in the last sanitary survey. DMWW has also reviewed our files regarding the legal control of the LP Moon ASR well. We found notes from 3/17/2004 referencing a discussion with Mike Anderson at the DNR.
