3/27/2012 I conducted a quarterly site visit to this facility on 23MAR12. Deb Watson showed me the litter picking records which indicated that no litter had been picked since 31AUG11 because it had been “too cold” each and every work day during that period. I challenged Ms. Watson on this point and asked if she understood the litter picking and recordkeeping requirements. She indicated that she was not clear so I went over Paragraph 567 IAC 113.8(3)f, which stipulates that off-site litter must be picked up daily unless conditions are “unsafe”, and the on-site litter must be picked daily unless prevented by working conditions. Also a log of unsafe or preventative conditions must be documented. Litter control was unacceptable and there was considerable trash in the road ditch off site to the south. Manager Mike Grell agreed that it was “terrible”, but said they just can’t get anyone to pick litter. I advised Mr. Grell that he was in violation of the Iowa Administrative Code and that he has an obligation to find a way to comply. I also noted that there was considerable waste visible through the daily cover of an inactive working face, and I advised Mr. Grell that this also was a violation. Mr. Grell indicated that it is difficult to stockpile sufficient daily cover because he doesn’t want the unused stockpile to be rained upon. I advised Mr. Grell that he must comply with the Iowa administrative Code even if it was difficult, and that I would send an NOV for the multiple violations I had observed. DAVID MILLER
