4/16/2013 DNR’s Alex Moon, Mike Smith and I met with the Butler County Solid Waste Commission and their engineer, Cindy Turkle, on 15APR13 to discuss the closed Butler County Landfill. The site is 20 years into the 30 year post closure period, generates more leachate than expected, and data from some monitoring wells at the property boundary suggests that minor contamination could be leaving the property. DNR indicated that, if the status quo continued, we likely would not allow the County to “walk away” at the end of the post-closure period. At some point it must be determined whether contamination was leaving the property and, if so, what was the extent. Mike Smith suggested the Commission consider implementing an off-site investigation of the ground-water issue, and also a feasibility analysis to help clarify what demonstrations might be needed to determine if the site conditions were sufficiently static that post closure care could be reduced or eliminated completely. We also discussed the eventual shut down of the leachate collection system, and DNR indicated we would need to understand what the equilibrated leachate head would be before we approved cessation of leachate management. One possibility to make this determination might be to shut down the leachate collection system and monitor leachate levels. DNR made it clear that we were not requiring these activities, we were merely explaining to the Board what information that DNR would need if the Commission intends to cease post closure care at some point. Mike Smith offered to suspend the required ground-water monitoring for a period so that the funds that would have been devoted to that activity could be applied to this other analysis. The Commission voted to authorize Cindy Turkle to develop a Work Plan to move forward on these issues. DAVID MILLER
