3/2/2023 On 2/15/2023, Noah responded with: "I can't recall if they or you have talked to Alliant directly. Mike gave me the Alliant environmental head's contact info. He might not be the one to talk to, but he can point you or them in the right direction. For well interference, they need to try informal negotiations first anyway. And more than likely, this is a civil case, not an administrative one, so they should be talking directly to Alliant anyway." Rob Saunders with OGS was listed as the Alliant Contact. On 2/27/2023, I spoke with Freese and asked if he had ever spoken with Alliant. Explained I was unclear as to if we had a regulatory role in his complaint and asked if he had ever discussed his concerns with Alliant. He had not. Told him I would find that information and provided it to him. On 2/27/2023, I spoke with Sauders. He provided two point of contacts with Alliant, Chad Wall and Jeff Maxted. I provided the contact information to Mr. Freese via email on 2/28/2023 TERRY JONES
2/9/2023 I reached out to Noah Poppelrieter with DNR Legal last week to get some guidance on how to response to the complainant since the pond closure at BG was required by EPA. Noah indicated he would take a look at the project and get back to me. TERRY JONES
1/5/2023 Brian Rath, DNR Project Engineer with DNRs Contaminated Sites Section did a hydraulic analysis of the general area (see attached). Roth suggests there is a hydraulic connection between the River, the IGS pond, and Freese's pond. Historic low River levels were likely contributing to low water levels in Freese's pond but IGS dewatering may also affect it because of the hydraulic connection. Roth notes the GW flow from the BGS is toward the River, away from the Freese property. However, not aware of what authority the department has to address Freese's concern even if BGS dewatering is responsible. Will check with DNR Legal to determine a response for Mr. Freese.
