4/12/2018 On April 11, 2018 we sent a Notice of Violation letter to Mark Butz (see attached letter). BILL GIBBONS
4/9/2018 On April 6, 2018 I called Mark Butz about the stockpile. Mark said this was actually an area where they kept cattle late last fall into early winter which explained why things were all spread out. I told him there was still a pile of manure left there and that manure solids were wide spread and were even up on the edge of the creek bank. I also told him I saw where manure solids had run off into the creek. Mark said they would get over there and have the entire area cleaned up in the next 3 to 4 days. We also discussed putting a berm where the draw to the creek was to prevent manure solids from reaching the creek. I told Mark the berm was a good idea but the location was of concern also since it was so close to the creek. BILL GIBBONS
4/9/2018 On April 6, 2018 at 12:00 PM I met Eric Dursky at the stockpile site on the east side of York Avenue between 280th and 290th Streets. It was a flat area at the bottom of nearby hills right next to a creek which ran west to east under York Avenue. There was a pile of manure in the middle of the flat area and indications a much larger area had been cleaned up surrounding the pile. There was evidence of manure solids that had been scraped up but some still remained and this went right up to the edge of the creek bank. There was a draw to the creek and I could see where manure solids had washed down the draw into the creek. It was not presently raining so there was no runoff of manure solids into the creek while I was there. BILL GIBBONS
4/9/2018 On April 6, 2018 I called Eric Dursky the Mahaska County and Keokuk County sanitarian and told him I had spoken to Mark Butz with Geno Source who had promised better cooperation and to clean up the road. Eric said Joe from Recipient LLC talked to him again and was more cooperative and they were cleaning up the spilled manure. Eric also asked the county to bring out the maintainer for some final clean up. Eric mentioned however there was a manure stockpile at a different location on the east side of York Avenue between 280th and 290th Streets. Eric said the manure was as close as 50 feet from a creek bank and there was evidence of manure runoff into the creek. I told Eric I was coming out right away to investigate. BILL GIBBONS
4/9/2018 On April 5, 2018 I spoke with Eric Dursky. He had been there the previous day and also saw manure spilled on the county roads all the way from the feedlot to where they were stockpiling manure on a property on 275th Street just west off of York Avenue (owned by Todd Clarahan - Parcel ID 1236300008). I looked at some aerial photographs of the property and it appeared to be an OK place to stockpile manure. Eric said he had been working with the site manager Joe but was concerned about whether he was going to get good cooperation. I called the Registered Agent for Geno Source, LLC the company that owned Recipient, Mark Butz and explained to him what was going on. Mark said he was not aware of the situation and would get in contact with the site manager Joe and he promised all of the manure would be removed from the road. BILL GIBBONS
4/9/2018 On April 4, 2018 Jeff Prier with Field Office 6 sent pictures of manure spilled on the road at the intersection of York Avenue and 280th Street. They were taken by Jeff Thomann of Field Office 6 who investigated the complaint that same day (April 4, 2018). They had instructed the people from Recipient Farms to clean up the road. BILL GIBBONS
