3/22/2017 On 3/08/2017 I investigated this complaint. I met with Damon Powers at his property and observed mostly tire treads that were placed mainly inside an open front building. The amount was about 45ft x 35ft x 7ft. After discussion with Mr. Powers and a discussion with Mr. Jason Delaney by phone at Mr. Power's residence and again at Mr. Delaney's place of business it was determined that Mr. Powers had interest in further processing the tire treads for financial gain. Mr. Delaney informed me that 7 truck loads of tires treads, many chopped in half or smaller, were hauled to Mr. Power's property at Mr. Power's request and that he had contacted DNR DM SW staff around February 20 to February 24 2017 and was told this was an acceptable beneficial re-use. Mr. Delaney informed me that he had contacted DM SW in the past to verify approved re-use prior to letting processed tire product leave his site. I suggested to Mr. Delaney that he keep more detailed records in the future to document approved beneficial re-use. Mr. Delaney agreed to bring the tire treads back to his facility and did so this same day. I was contacted on March 9th and informed by Mr. Delaney that all tire treads were hauled back to his place of business. Mr. Delaney informed me that his shredder machine was vandalized the beginning of January 2017 and his is no accepting tires and is only processing tires generated from the equipment repair business also located at the same location as the tire processing facility.
