12/22/2023	Steve, DNR has sent a letter to Wendl Cattle Company Inc requiring submission of an NMP by 2/15/24. Regarding your comments pertaining to the crop yields utilized in the NMP that was accepted 8/21/23, DNR previously addressed this issue in the response to public comments, which you should have received via email on 8/25/23. If not, please see the comments below: 567 IAC 65.17(6)”a”(3)”2” allows producers to utilize proven yield methods with proven yields from multiperil crop insurance to calculate the optimum crop yield. Fawn Hollow utilized the information from multiperil crop insurance to determine the corn yields used in the NMP. Appendix B worksheets (worksheets for determining optimum crop yields) were provided and DNR staff confirmed that the worksheets correctly utilized the data found on the insurance form copies. The use of this information is allowed by the rules and, therefore, is considered an acceptable method for determining the optimum crop yield. DNR is aware that you have petitioned USDA to investigate Mike Butikofer's multiperil crop insurance yields.	BRIAN JERGENSON
