10/10/2019 On October 10, 2019 I talked to Bob Henderson. I told him I had been contacted about the compost stockpile regarding two concerns. The first concern was runoff from the stockpile getting into downstream ponds and streams and the second was the materials in the compost such as plastics and plastic bags that could cause a debris/litter problem. Bob said they put the compost pile behind a terrace this year to give it some protection from runoff and they had pulled out plastics and plastic bags to prevent the debris/litter problem. I mentioned a pond just downstream of the location and the creek below the pond outlet and that the material could produce a dark leechate during rainfall events. I recommended he put some additional protection (recommended placing some hay bales around the stockpile or constructing a berm) around the stockpile to protect downstream surface waters. He said he would take additional measures. BILL GIBBONS
10/10/2019 On October 7, 2019 Bill Gibbons talked to an adjacent landowner (anonymous) who had concerns about runoff from the compost stockpile at 168th Street and 730th Avenue. He said last fall (2018) runoff from the same type of material put at this location went into his pond and killed all of the fish. He contacted the landowner Bob Henderson (641-777-0843) and Mr. Henderson did pay to have the pond re-stocked. The caller said after a recent rainfall dark colored material is in his pond again from runoff from the stockpile. I told him I would contact Bob Henderson. BILL GIBBONS
9/30/2019 Complaint investigation 9/26/19 continued: Anthony stopped at the residence at 6793 165th Street and talked to Mrs. Forsythe (wife of Robert Forsythe) about the stockpiled compost. Bill Gibbons received a call from Robert Forsythe about Anthony's visit. He said he was the land owner and his farming tenant was the person who was stockpiling the compost material to be spread on the fields. He was concerned about what was in the compost and the foreign materials plastics and plastic bags. Bill Gibbons told Rod it was OK to land-apply the compost on the fields however if there were litter problems such as plastic bags blowing around and plastics running off into surface waters from rainfall events he would be responsible to prevent that situation or clean it up afterwards. In addition while the material was being land-applied it would have to be policed to prevent littering. Bill asked Rod if he knew whether the compost came from Chamness in Eddyville, if it had been paid for, who transported the material and who was going to land-apply the material. Rod said he would call his tenant and call Bill back. Rod called Bill Gibbons back and confirmed the material came from Chamness in Eddyville, his tenant got the material at no charge and used their own truck to haul it from Chamness, the tenant would be the one to land-apply the material. Rod said after looking at the material he and his tenant decided not to land-apply it on his fields and the tenant would remove the material. BILL GIBBONS
9/30/2019 Complaint investigation 9/26/19 continued: Anthony found a second stockpile location approximately 2 miles west of Avery at 6793 165th Street, Albia, IA. There is a residence at the address and there were stockpiles on the north and south sides of 165th Street just east of the residence. Anthony reported there were many plastic bags, a few bottles and one deodorant stick within the piles. 9/30/2019 On Thursday, September 26, 2019 Anthony Bigger with Field Office 5 investigated the complaint. He went to the site at the intersection of 168th St. and 730th Ave. approximately 2 miles east of Avery. He saw a stockpile of the compost material and it contained foreign material including large pieces of garbage bags. See Pictures IMG_0326 & IMG_0330 and aerial photo of field location. BILL GIBBONS
