10/30/2012 On October 29, 2012 we sent a Notice of Violation for starting construction without first obtaining a General Permit No. 1 for "storm water discharge associated with industrial activity for construction activities" [567 IAC 64.15] (see attached letter). BILL GIBBONS

10/29/2012 On October 10, 2012 I received the following E-mail from Joe Griffin: We’ve received the app. SOP is that a letter is generated requesting any missing items so unless we receive the second notice before the app. is processed, a letter will be sent out about the notice and anything else that may be necessary. 10/29/2012 On October 8, 2012 I received a reply back from Nick Rowe as follows: Joe & Bill, The materials were sent in last Thursday so please let me know if you don't get them by tomorrow. We were waiting on one of the paper notices to come back and when we called them last week they said typically notices are only sent off once per month so that was the delay. The paper was going to send us the notice this week. We sent in the permit app, check, and one of the notices last Thursday but are waiting still on the second notice which we should be getting any day also. I will email and send Joe the second notice once I receive it. The contractors used the black dirt strippings to build a small collection basin to contain runoff and prevent erosion at the NW corner of the basin as indicated in the construction specifications. The dike has been removed and now Kevin is seeding and mulching the dikes to prevent erosion. The site never had any erosion, discharges, or any rainfall for that matter. 10/29/2012 On October 10, 2012 I checked with Joe Griffin in the Stormwater Permits Section. He had still not seen a Notice of intent. I sent the following E-mail to Nic Rowe: Nic, I have been checking with Joe Griffin in the Stormwater Permits Section and they have not seen the notice of intent, copy of public notices, and check for the Kevin Blood site. This is getting quite a bit of attention from Iowa Citizens for Community Improvement (ICCI) and they are aware that construction of the basin was started and completed without the department receiving the Notice of Intent. Kevin is aware of this and the fact that we will be issuing a Notice of Violation for starting construction without having the General Permit No. 2. 10/29/2012 On October 8, 2012 I met Kevin Blood at the site of the new basin. The basin was nearly completed and they were putting top soil over the upper and outer banks. The pipeline had been put in (trenched in) from the road (S52) going east to the basin. The rest of the piping for the pipeline was laid on the ground going all the way back to the Kevin Blood Dairy (to the northwest). Kevin and I talked about the need to have the General Permit No. 2 before starting construction and I told Kevin our office would be issuing a Notice of Violation. We also discussed the pollution prevention plan. There was actually a copy of the plan in the construction permit application and it called for silt fence and other erosion control measures and also said that Kevin would be responsible for weekly inspections and keeping an inspection log. Kevin said he knew they were going to seed the basin and use fabric to hold the seed and soil in place and use mulch for cover. Kevin said he would be people started immediately on the seeding, fabric and mulch, and installing silt fence. BILL GIBBONS
10/29/2012 On October 8, 2012 I received an E-mail from Nic Rowe as follows: Hi Bill, The storm water permit was sent off to the IDNR last week. We were waiting on getting a public notice back from one of the papers. We finally called the paper last week and I guess they only send back notices at the end of the month so that was the reason we were waiting a few weeks on that notice and permit submittal. 10/29/2012 On October 5, 2012 David Goodner with Iowa Citizens for Community Improvement (ICCI) brought in a complaint about the Kevin Blood. David was contacted by a party in Marshall County who noticed construction of an earthen basin and construction of a pipeline from the Kevin Blood Dairy to the basin which was about 1 mile southeast of the Dairy. David had checked with Joe Griffin with the Iowa DNR Stormwater Permits Section and a General Permit No. 2 for "Storm Water Discharge Associated with Industrial Activity for Construction Activities" had not been issued to the Kevin Blood Dairy or for a project in this area. I looked at the Kevin Blood AFO file and a construction permit had been issued for construction of a pipeline and basin on September 19, 2012. I checked with Joe Griffin in the Stormwater Permits Section and they had not received a Notice of Intent from the Kevin Blood Dairy. I called Kevin Blood and he said they had already started construction of the basin and pipeline and the basin was almost finished. I asked him if they had applied for a General Permit No. 2. Kevin said he believed they had published the public notices but thought Nic Rowe the project Engineer with ProAg Engineering was handling the permit application. Kevin said he would check with Nic Rowe and call me back. I told Kevin I should probably come out to the site and he agreed to meet me on Monday, October 8, 2012. BILL GIBBONS
