3/21/2013 I went to this location on 20MAR13 and spoke with complainant Sandra Brennan. She stated that water mixed with oil had been running from Frank’s property across her driveway and then out into her yard. I inspected the areas she indicated but found no evidence of oil staining, which I stated. She then advised me that she had taken samples of the water and showed me three jars full of ice. The ice was generally clear with a sediment layer on the bottom, but no evidence of a sheen or petroleum odor on the top. I again remarked that I could not find any evidence of oil. Additional conversation revealed that her underlying complaint was that a culvert along a private road on Frank’s property was plugged and a large quantity of water ran across her driveway during the big rain/snowmelt event a couple weeks ago. This had created rill erosion in her gravel driveway, which she then had to repair at her own effort and expense. I observed a culvert which did not seem to be draining properly and I also saw some areas where soil and gravel had apparently washed from her driveway. I advised Ms. Brennan that I would speak to Frank’s about the culvert, but that I could not substantiate her assertion that there was oil running off of Frank’s property. I then went to Frank’s and spoke with Manager Branden Passow. He stated that the culvert was indeed plugged and it was a real mess during the big precipitation event, and it had flooded back into his operation as well. However he denied that any oil had run off, rather asserting that it was sediment-laden water. Mr. Passow indicated that he intended to clear the culvert, but he had to wait for the next thaw. I suggested that Mr. Passow keep Ms. Brennan apprised of the proposed schedule for the culvert repair, but he indicated that the current status of their relationship was not particularly conducive to cordial communication.
