4/29/2020 There is some history on this issue at this site. 567 IAC 113 states that all off-site litter must be picked every day. However, the farmer does not want landfill personnel in his field during the growing season and there has been some acrimony between the parties on this; so, I have not enforced that requirement during the growing season. I investigated this complaint on 20APR20. The video did show some litter, but it did not seem to me to be excessive for a landfill in the springtime. I went to the Landfill and called manager Dan Aastrup from the parking lot. He texted me that he was on a conference call, and they stopped picking on-site litter due to the COVID 19 emergency. I went to a high point on the east side of the landfill and looked out into the field where the video was taken. A landfill employee was actively picking the litter and they seemed to be nearing completion. I went to the working face, made a sign with my phone number, and held it up in the truck window so operator Bruce Rewoldt could call me. I asked him why they stopped picking on-site litter and he said that they were concerned about being exposed to the virus by touching trash. I indicated that I would send him the OSHA solid waste guidelines which state that municipal solid waste can be safely handled using gloves and eye protection. I asked when they started picking the off-site trash in the field and he indicated that they just started this week because the farmer said he wanted to get into the field. I reminded him that all off-site trash must be picked up every day, and that my previous dispensation on this requirement only applied to the planting/growing season when the farmer prohibited them from coming onto the property. Because there could have been a miscommunication, I chose not to designate this as a violation. I sent an email and the attached letter clarifying the requirements. DAVID MILLER
