8/28/2017 From: Miller, David <david.miller@dnr.iowa.gov> Date: Mon, Aug 28, 2017 at 1:10 PM Subject: Rembrandt Compliance Schedule To: Lenny Larson <lenny.larson@is-grp.com> Lenny – This email responds to your request to extend Rembrandt’s “comply with final effluent limits” on the chloride compliance schedule from August 2018 to January of 2019. Changing compliance schedule “comply by” dates can be problematic and requires reopening the permitting process, as well as extra time by the DNR wastewater staff. We generally don't do so for schedule delays within the control of the permittee. DNR does not consider a compliance schedule to be in substantial non-compliance until a milestone is more than 90 days past due (and the effluent limit is not met). A missed “comply by” date of more than 90 days would result in a Notice of Violation; however, DNR would likely not initiate an enforcement action (fine) to a party working in good faith and keeping DNR informed of their progress.
