11/6/2015 Don (no last name given) called and said that he had just been to the Fort Dodge Landfill where he was told that they do not accept cut tires, and he wanted to know if they were allowed to refuse them. I went over 567 IAC 117.3 with him which states that land disposal of whole tires is prohibited, but landfills are still required to accept whole tires, which they then send to off-site recyclers. I further stated that 567 IAC 117.3(1) says “Waste tires shall be accepted at a permitted sanitary disposal facility for final disposal if the tires have been cut into pieces 18 inches or smaller” so, yes, they have to take tires that have been cut into pieces of less than 18 inches. I stated that I have had discussions with the current landfill Director about this issue and I was aware of her disdain for cut tires, and that she had substantially raised certain disposal rates to discourage cut tires coming in. I asked Don if he wanted me to remind the Director of the rule requirements. He said no, he wasn’t going to spend the time to cut up a tire just so it could be buried, but he just wanted to know what is and is not allowed. DAVID MILLER
