Spilling Loads on Highways. A vehicle shall not be driven or moved on any highway by any person unless such vehicle is so constructed or loaded or the load securely covered as to prevent any of its load from dropping, sifting, leaking, or otherwise escaping or its load covering from dropping from the vehicle, except that sand may be dropped for the purpose of securing traction, or water or other substance may be sprinkled on a roadway in cleaning or maintaining such roadway. The provisions of this section shall not apply to vehicles loaded with hay or stover or the products listed in section 321.466, subsections 5 and 6. DAVID MILLER Environmental Specialist Senior ____________________________________________ From: Lori King [mailto:[email protected]] Sent: Monday, June 01, 2015 1:02 PM To: Miller, David [DNR] Subject: Question Dave, I have a question for you regarding the cover policy that we have. Is this policy in the Iowa Code or is it strictly landfill policy? I have found it in several different places and read it as that all loads need to be covered, no exceptions. Then a few lines later it says that it is up to the discretion of the landfill employee if it is a hard to cover load. I recently told an older customer that if they didn’t have straps that a heavy spare tire could be used to hold the tarp down. Is this okay, or am I actually causing a problem by suggesting this? Thank you for your help. Lori J. King Office Manager Floyd-Mitchell-Chickasaw Solid Waste Management Agency DAVID MILLER
