8/11/2014 From: Miller, David [DNR] Sent: Monday, August 11, 2014 1:42 PM To: Kossuth3 [DOT Contact] Subject: Recycling in Kossuth County DNR does not consider recyclables to be governed by the geographic restrictions in the 28E agreements, unless they are being landfilled. Recyclables as a commodity are not regulated in Iowa, and DNR has no restrictions on who may haul them where. Your Transfer Station Permit allows, but does not require, you to store recyclables at the facility. DNR recommends that permitted facilities provide the widest possible array of disposal services for the service area, but you are only obligated to take solid waste and tires. DNR would encourage, but not require, you to either store the recyclables or help find another home for them if a vendor becomes unavailable. As far as DNR is concerned, you may do with recyclables as you see fit with no DNR involvement. You left a voice mail and I want to make sure that I understand correctly. The city of Fenton Iowa is part of the Kossuth Waste Management Association. Fenton is located on the west side of our service area. Fenton lost its contractor that hauled its recyclables (paper, plastic, tin, etc.) to our recycling transfer station. Fenton has a contractor that is interested in collecting the recycling. This contractor would then be hauling the recyclables to a facility that is not in our service area. 1. Is this proposal acceptable with the Iowa DNR? 2. Is any action necessary from the Kossuth Waste Management Association? 3. If Fenton changes to a different contractor for a third time a would desire to begin to transport their recyclables to us again, would the Kossuth Waste Management Association be required to begin receiving their recycling again.
