8/24/2009 On Friday, August 21, 2009 John Meades with Tanknology (952-292-9611) called me about an underground storage tank inspection he was doing at Love's Travel Stop #361 in Newton (20080001). John had two questions about the inspection. First they had two diesel fuel tanks and one tank that held either vegetable oil or animal fat depending on the time of the year. The vegetable oil / animal fat tank contents were blended with either of the diesel fuel tanks as they were beint filled by the transport. John asked if the vegetable oil / animal fat (they referred to as B100) was a regulated substance and if the piping used to blend the fuel between tanks required leak detection. He also described how the fill pipes for these three tanks were in an area surrounded by curbing which was open on one end; however there was an intake that led to an oil / water separator in front of the area where there was a break in the curbing. They did not have individual spill buckets for each fill pipe but used the curbing and intake as spill control. John wanted to know if this met the regulatory requirement for spill control. I told him I wanted to discuss these items with Tom Collins and would call him back. On Monday, August 124, 2009 I talked to Tom Collins in the UST section. Tom said the vegetable oil / animal fat if it was 100% that substance was not regulated and line leak detection between the tanks would not be required. For the spill control there is no specific reference in the rules as to how much capacity is needed and how spill control is achieved. Their set up of placing curbing around the fill pipes and having an intake to a separator can be used as spill control. On August 24, 2008 at 8:00 AM I called John Meades. I told him if the content of the one tank was 100% vegetable and/or animal fat was not regulated and line leak detection for the piping to blend into the diesel tanks did not require leak detection. I did tell John that any release of the vegetable oil / animal fat would have to be reported and handled like any release or spill so there was still accountability involved. For the fill pipes the set up they had for spill control woulld meet the regulatory requirements. BILL GIBBONS
