2/4/2014 Date:09/18/2013 Sender:[email protected] Note:Fort Dodge Public Works Director Greg Koch called and stated the City was about to purchase 96 gallon garbage bins for each municipal solid waste customer, and he had heard that there was a limit to the size of containers that could be distributed to customers within a solid waste planning area if the planning area had not met the landfill diversion metrics in their comprehensive plan. He wanted to check this out before the spent $78,000 on the containers. I consulted Subrule 567 IAC 101.13(8) and advised Mr. Koch that planning areas failing to meet the goals in their comprehensive plan have a limit of 100 gallons of solid waste per customer per week, so the 96 gallon containers were lawful if picked up no more frequently than weekly. ------------------------------------- CINDY GARZA
