9/18/2013 I attended the 17SEP13 Environmental Protection Commission (EPC) meeting in Mason City where the EPC was to determine if the NCIRSWA Landfill enforcement action should be referred to the Iowa Attorney General (AG). NCIRSWA acknowledged the violations, but made the case that the Board had no way of knowing about the ongoing non-compliance because a rogue employee had kept the numerous Notices of Violation from the Board. Once the Board became aware of the violations they took immediate action, terminated the individual’s employment and hired a new Director. The NCIRSWA attorney asked me to comment upon the actions taken by the new Director and I indicated that I was well pleased with the recent progress on operational issues since she had been hired. DNR attorney Jon Tack argued that the violations were egregious and that, despite recent improvements, future compliance with could best be attained through a compliance schedule in a District Court Order. Dave Sheridan of the AG’s office asserted that the violations were arguably the worst ever brought before the EPC in a landfill matter and that NCIRSWA had gained a distinct economic benefit from non-compliance. The EPC voted to refer the enforcement action to the AG. DAVID MILLER
