7/19/2013	Minnesota Rubber missed their 2nd quarter sample. They did send in a sample, but their lab lost their computers and the sample results were lost. Barb said she told them to resample in June and they chose not to do this, but to wait until July to collect the sample. Bard said this conversation was on 6/26/13, close to the end of the month, but she thought they would have had time to collect another set of samples in June. She wanted to know if she should issue an NOV, which she said would put the industry in Significant Noncompliance and would required a public notice in the newspaper. She wanted an immediate answer because she was leaving on a two week vacation. Complicating the matter is the fact that the lab told all their clients that the DNR would issued them letters stating that enforcement would not be taken against them. This notice was sent out without DNR approval. I told her that a definitive answer would have to wait because the WW people in the FO were all gone as was Eric Wiklund, the DNR Pretreatment Coordinator. I told her that I thought this matter could wait until she was back from vacation so that a reasoned response could be given. Kathy Lee called a little later and we discussed this matter.
