5/2/2013 Registered tire hauler Don Pirie called and stated that the NCIRSWA landfill said that DNR said that the landfill could no longer take cut up tires, and he wanted to know why. I indicated that I was not aware that the DNR had taken this position and would check on it. I spoke with DNR’s Amy Buckendahl, who happened to have recently been at this landfill on other business, and she had learned that the interim manager, Cindy Turkle, had made the determination that they would no longer accept tires, and that the DNR was not involved in the decision. We also discussed the language in 567 IAC 117.3(1) which states that landfills SHALL take cut tires. Ms. Buckendahl indicated that if a customer pressed that point, the landfill could merely charge an exorbitant price for cut tires and achieve the same goal. I called Mr. Pirie back and stated that the DNR’s position is that cut tires can go into landfills and that the decision to cease taking cut tires was made solely by the landfill. DAVID MILLER
