4/11/2013 Permitted appliance demanufacturer Russ Trulson (Hancock County) came into the office and stated that the Kossuth County Transfer Station had called him accused him of violating the solid waste 28E Agreement by taking appliances out of the Kossuth County planning area. Mr. Trulson wanted to know if it was true that he couldn’t take appliances from Kossuth County, because he had been doing it for years. I told Mr. Trulson that the 28E Agreement did not apply to appliances. Kossuth County Engineer Doug Miller called me shortly thereafter, mentioned Mr. Trulson’s name, and asked if the 28E agreement applied to appliances. I explained that the DNR considered the 28E Agreements to apply to the final disposition of solid waste, that DNR considered appliance demanufacturing to be recycling, and therefore was not subject to the geographic boundaries of 28E Agreements. Mr. Miller indicated that he understood. I also called Mr. Trulson back and advised him that I had talked to Kossuth County and told them that appliance demanufacturing was not subject to the geographic limitations of the 28E Agreement.
