10/22/2012 Tim Monroe of Veenstra & Kim called asking about requirements associated with the utilizing soil excavated from this site as fill. He stated that he had called Cal Lundberg earlier today and Mr. Monroe indicated that Cal Lundberg had opined the “motor oil” concentration maximum of 95 ppm “was not very high”. I advised Mr. Monroe that Mr. Lundberg’s assertions on this matter held greater sway than anything I might say, and asked him what else I could tell him. He wanted to know if I was familiar with the site and I indicated that I was, to some degree, and had had a similar conversation with another party in August regarding the disposition of the remediated soil. I indicated that I had seen some analytical results at that time and, provided we were talking about the same site and set of testing results, there were no analytes detected that exceeded Chapter 137 Standards, and therefore the fill was unregulated. I suggested that they use discretion when using it as fill (i.e., try to keep it out of drainageways and cover it with clean fill if possible) but that it was lawful to use as fill offsite.
