7/10/2012 Josh from Van Diest Supply called and said he was in a discussion with Central Disposal regarding acceptance of a certain waste stream. In 2011 DNR had apparently issued a special waste authorization (SWA) for this waste stream to be disposed in the Lake Mills landfill, and Van Diest had previously been testing pH quarterly to satisfy Waste Management. Waste Management is now requiring pH testing of every load, and Josh wanted to know if he “renewed” his SWA with the DNR would then perhaps he would not have to test every load? I explained that the SWA is a service that DNR provides to landfills if they have a waste stream that they want DNR to approve. The SWAs do not expire and need not be renewed, as long as the waste stream is materially similar to that for which DNR reviewed the testing. I further explained that Waste Management was free to require any testing that they chose and DNR could not prohibit them from doing so. I also clarified that the testing which Waste Management was requiring was probably being used to demonstrate that the waste stream was consistent with the SWA. Josh indicated that he understood and would continue his dialogue with Waste Management. DAVID MILLER
