6/28/2012	David James: I am building a hog confinement “up in the Sidney area.” It is Parks Finishing J6 LLC. I need to know if I need secondary containment. Dan Olson: There is a 500 foot separation distance required to a water source. A water source is defined as having water flow, which can be occasional as in “only after a rain,” and a defined bed and banks. Based on what I see in the aerial photo and the fact that you are already talking about secondary containment, I would say the draw coming up towards your proposed building site, as it exists today, is a water source. Would you agree? David James: Yes. Could we grade it out so it is not a water source? Dan Olson: Your options are: 1) move the site so it is at least 500 feet from the water source. 2) Regrade the area so it no longer meets the definition of a water source and maintain it in that condition. 3) Construct secondary containment, which must be designed by an engineer and approved by Paul Petitti prior to construction.
