4/6/2012 Called to inquire if there would be some issues (i.e. separation distance requirements) if this site was to be sold to a new owner. He was told that the contractor did not orient the building exactly like the engineer had proposed it, but that the DNR had "grandfathered them in." I informed him that since the site was orginally constructed in 2006, the separation distances now (or for a new owner) are those in Table 6 -- so for a site with <1000 AU, the required distance to all residences is 1250 feet. I pulled up an aerial photo of the site and though it is close, it appears that they have at least 1250' to both the Aalbers residence to the SE and the neighbor to the SW. I informed him that should the site sit empty for a 6 month period, we would require that all manure be cleaned out and properly land applied. I also informed him that the new owner of the site would be required to submit a new MMP within 60 days of taking ownership. Expansion of the site to >1000 AU may be difficult due to the 1875' separation distance, but I see no reason why the site could not change ownership and continue at the existing size (700 head dairy).
