6/28/2011 DNR received a June 27, 2011, letter from Waste Management’s Debra McDonald advising that the storm water basins at Central Disposal had been impacted by leachate seeps and that they were near capacity. This happened in 2005 and DNR allowed, after analytical testing, Waste Management to discharge directly to surface water, on a one time basis with a written warning that if it happened in the future they would need to get an NPDES Permit. Michelle Johnson and I called the new site manager, Tom Buchholz. The wet weather of late has saturated the cover, and the associated surcharge has put pressure upon the gas which in turn is mobilizing leachate. In addition to a substantial leachate seep of which DNR was aware, there have been several more small ones, along with a material one over on the west side. Based upon the presence of these seeps, Mr. Buchholz advised Ms. McDonald that the storm water was impacted by leachate and could not be managed as regular runoff. Ms. McDonald then wrote the letter suggesting that, after testing, they should be allowed to discharge the storm water as they were allowed to do in 2005. We advised Mr. Buchholz that DNR would work toward a solution with Waste Management on this, but they should not automatically assume that they would be allowed another “emergency” discharge. Mr. Buchholz was having the ponds sampled and he hoped to have the results in time for our previously-scheduled meeting next week. They still have some capacity in the storm water basins, but another 6” of rain without material evaporation will take them up to a critical point. DAVID MILLER
