6/20/2011 1045 hrs: After discussing the matter with David Hopper, FO2, we were in agreement that there were no requirements applicable to the stormwater retention pond once site construction activities were done; in fact, they could remove the pond if they wished. David was in agreement with what I had previously told Heath. I contacted Heath and re-iterated that they could legally do what they wanted with the pond discharge; however I strongly advised against tiling it out. TRENT LAMBERT
6/20/2011 1045 hrs: Heath had called on 15 JUN 11 and asked about the stormwater retention pond at the site. He stated that the pond discharge daylights on-site, goes to the county road ditch, and ultimately to a tile intake on a county tile line. However, when there is enough discharge, according to Heath, the intake cannot take all the water and some of it then cuts across a farmer's field. Heath wanted to know if they could tile the pond discharge directly to the county tile; or at least still daylight it, but install another tile intake upstream of the existing one. I stated that as this was a stormwater pond built per a General Permit No. 2, there were no monitoring, discharge, etc. requirements. Therefore, I didn't see why they couldn't do as he proposed, however I would caution against tiling it out because if there was ever a problem, we wouldn't know it until we had dead fish in a creek a couple miles away. I stated I would talk to our main stormwater person and get back to him. TRENT LAMBERT
