7/20/2010	The construction permit application for the above referenced facility included plans for a separate runoff retention structure for the silage storage area. This retention basin was not required by IDNR design standards but was included in the construction permit. Per my telephone conversations with Dan DeHaan of DeHaan Grabs & Associates on August 9 2006 August 14 2006 and August 16 2006 it is the understanding of this office that Natural Milk Production is seeking permission to place silage in the silage storage area before the runoff retention structure is completed. It is also the understanding of this office that the runoff retention basin will be completed by the end of September. This office agrees that it is reasonable to allow the use of the silage storage area prior to completion of the runoff retention basin provided that there is no discharge from storage. It is expected that if silage is placed in the storage area the runoff retention basin will be completed as soon as possible which shall not be later than October 1 2006.This letter does not imply any exception to Subrule 567 IAC 62.1(1) Iowa Code 455B.186 or any other rule or statute of the State of Iowa. Furthermore this letter shall not prevent the department from taking action with regard to any discharge from the referenced facility.	AfoLOADInsp-2-07/20/2010
