7/20/2010 On November 30 2006 I conducted routine manure management plan (MMP) and land application records inspections for the above referenced facilities. During the inspection it came to my attention that your hog confinement facilities are using the same acres as The Beeck facilities (Beeck #1 and Beeck #2). As you are aware when these sites were originally constructed you and Mr. Beeck were part owners in all of the sites. At this time the department allowed you to have common acres in the MMPs as long as adequate acres were available and over application did not occur.However during the course of the last 1-1/2 years the Beecks and you have separated the sites and are each independent owners of your facilities. It is recommended that new MMPs be submitted for each of your facilities and that the MMPs not have duplicate acres.The due dates for a Phosphorous based MMP for your sites are as follows: •Goat Farm – original MMP in 4/19/05 P-Index due 5/1/07•S & S Feeders – original MMP in 6/6/99 P-Index due 4/1/09•Goodrich Finisher – original MMP in 9/1/04 P-Index due 9/1/06In conducting a file review I noticed that you were sent a letter dated March 24 2006 stating that the P-Index MMP for Goodrich Finisher was due on September 1 2006. To date it does not appear as if this was submitted. In following departmental procedure you have 30 days to submit the P-Index MMP for this facility. Failure to submit the plan by February 10 2007 will result in a referral to the DNR legal section in Des Moines and will include a monetary penalty of $3000.A letter will also be sent to Mike Beeck advising him of the recommendation to exclude all duplicate acres as well.
