12/18/2023 Tanko sent an email on 12/18/2023 asking if DNR or EPA issued sanctions, actions, fines, or otherwise based only on a high concentration limit or persistent exceedances of a mg/L limit? We've never exceeded our 30-day or daily loading (lbs/day) limit for outfall 002 chlorides. I responded: The chloride standard is based on a mg/L concentration limit and not mass so yes, if chloride concentration exceedances continue to a point where a facility is classified as "Significant Non-Compliance" for consecutive calendar quarters, then elevated enforcement is possible. I'm not sure if you could request a permit amendment to have a chloride compliance schedule put in Whirlpool's permit which could provide time to achieve compliance or if we'd have to issue a Consent Order with a timeline. My preference (and I'm sure Whirlpool's) would be to do it through a permit amendment but I'd have to consult with our Permit Writers to see if that is an option. TERRY JONES
