12/7/2022 Hillari called and reported that they did not sample for total nitrogen or total phosphorus in November. Per their permit, they are only required to sample when land applying. No land application occurred in November; therefore, they were still in compliance. See emails below. During the month of November samples were not collected, our other two layer facilities were infected with highly pathogenic avian influenza and the site was on lockdown to prevent the spread of the virus. No land application was completed during the month of November, samples were pulled on October 11th and last application date was 9/15/22. Once this oversight was recognized we had samples pulled from the Dows Vat prior to the land application beginning on 12/6/22, all of this information will be documented and reported on our annual operating report. As you state in your email, total nitrogen and total phosphorus testing are only required during months of land application. Since no land application occurred in November, no sampling was required. So to clarify, your facility is in compliance with the sampling requirements in the permit. Let me know if you have any questions.
