What you described would be a prohibited discharge per 567 IAC 62.1(1). 62.1(1) The discharge of any pollutant from a pointsource into a navigable water is prohibited unless authorized by an NPDES permit. For purposes of this subrule, an NPDES permit includes an NPDES permit issued by the administrator prior to approval of the Iowa NPDES program. Although what you describe may not directly enter a water of the state (depending on the location), it would likely make it to a storm water sewer and daylight to a surface water eventually. Alternatively, the open drain could also result in a hazardous condition in accordance with 567 IAC 131.1(455B). A hazardous condition means any situation involving the actual, imminent or probable spillage, leakage, or release of a hazardous substance onto the land, into a water of the state or into the atmosphere which, because of the quantity, strength and toxicity of the hazardous substance, its mobility in the environment and its persistence, creates an immediate or potential danger to the public health or safety or to the environment. These events are reportable to the Iowa DNR. I hope this helps. Anything that comes out of the pipe would go onto the ground without treatment. We typically require all house drains to go to the sanitary sewer. He has pour the concrete and does not want to change the discharge point. I was wondering if I could get the IDNR position on an issue like this? Thank you for your thoughts.
