2/12/2020 Hi, Megan. Yesterday we discussed the Steve and Ken Jennett confinement site. According to Mr. Jennett, there is about 6 inches of freeboard in the below building pit. Additionally, you stated manure was not pumped and land applied this fall because the applicator did not show up. The DNR does not consider 'the applicator not showing up' as an emergency, per 567 Iowa Administrative Code paragraph 65.3(4)"c"(1) (listed below). However, this rule also states for confinement feeding operations that have no manure storage structures constructed after May 26, 2009, the department will accept insufficient manure storage capacity as a reason for emergency application. The last manure storage structure constructed at this site was pre-May 26, 2009. However, at this time, we can not grant permission to land apply on frozen ground due to the following reasons: 1) Steve and Ken Jennet are not certified manure applicators. Only certified manure applicators can land apply manure from this site. 2) We have not received a full MMP for this site since 2010. There was some internal confusion on this as the chicken manure is covered under a 200A license but the hog confinement manure must be covered under the MMP requirements. Please submit the full, updated MMP as soon as possible. 3) Because we have not received a full plan, I requested documentation of RUSLE2 and P-Index. However, we also need verification on updated soil samples. 4) The RUSLE2, P-Index, and soil samples are needed to document that the proposed application fields do not have a P-Index rating greater than 2 (see 567 - 65.3(4)"d" (below for reference). 5) Additionally, per 567 - 65.3(4)"d" (below for reference), specifically states all tile intakes must be temporarily blocked during application and for 2 weeks following the application. When we spoke you stated that according to Mr. Jennett, there are approximately 75 intakes in each field. These fields are not authorized for application unless the intakes are properly blocked. 6) We also discussed the proposed fields. Because surface application will occur, separation distances must be met. The fields being proposed are very near residences and water sources. 7) IF additional ground is sought for application, we will need documentation of soil samples, RUSLE2, P-Index, and manure agreements submitted for review.
