1/2/2019 Olson, Dan p, 5:16 PM to Keith, Kent Kent, A construction permit was issued for the McKenney Finisher (#64502) in 2008 and included permit conditions relating to several master matrix items, including item 30, which requires an additional separation distance 500 feet above and beyond the minimum required separation distances of 0 or 750 feet to the nearest residence not owned by the owner of the confinement, and item 35, which requires an additional separation distance of 400 feet above and beyond the minimum required separation distances to the closest high quality water, high quality resource water, or protected water area. Since the site did not claim points on master matrix item 26e, you do not need to obtain authorization prior to surface application. Also, while the annual prohibition on application to snow covered ground went into effect December 21, it will not apply to frozen ground that is not snow covered until February 1. If you need to surface apply liquid manure from a confinement to snow covered or frozen ground after the relevant dates, you will need to provide notice to DNR but will not generally need to obtain permission prior to the application. The notification must identify the facility, the facility ID#, the owner, the reason for the emergency application, the application date(s), the estimated number of gallons to be applied, and the application fields as identified in the MMP. The emergency provision for application to frozen or snow covered ground after the aforementioned dates only allows you to apply enough manure to get by until spring. Any tile intakes downgradient from the application must be plugged during the application and for 2 weeks following the application. The fields must have a P-Index of 2.0 or less and should be flat and far from any streams. All separation distances for surface application must be followed.
