6/6/2018 Steve Bliesner and Brandon Gibson from Daybreak Foods came to the office to meet with Jeremy Klatt and I to discuss DNR’s June 6, 2018, wastewater inspection, as well as David Knoll’s May 2, 2018, investigation which documented ammonia in the runoff from the Vincent – Eagle Grove site. Mr. Bliesner adamantly disputed Mr. Knoll’s assertion that the ammonia detection was related to the wastewater application, and he suggested that it could be attributed to normal background in the storm water. Mr. Klatt made the point that there could be water quality violations even if they were not directly attributable to the wastewater operation. Mr. Bliesner asserted that he was in compliance with the Permit, but Mr. Klatt noted that DNR could not make that determination because there was poor recordkeeping and errors in the MORs. I noted that every time DNR had conducted a wastewater inspection since 2004 we found violations, and that there had been no material changes to the wastewater operation or infrastructure. We reached the following agreement: 1 - DNR would not immediately initiate legal action, although we reserved the right to do so after a compliance evaluation. 2 - I would issue an NOV for the violations we found in the June 6, 2018, inspection and would include a list of items to which Daybreak must respond, including correcting the errors in last year’s MORs and resubmitting. 3 - DNR would review the corrected MORs and determine compliance with the Permit. 4 - DNR and Daybreak would meet again in the August/September time frame and Daybreak could present their case that the ammonia detections were background, as well as describe any operational or infrastructure improvement which they had or will implement. 5 - DNR would make a decision on a possible enforcement action after hearing Daybreak’s case.
