On August 10, I talked to the city administrator and he reported that on August 26 the Board of Adjustment did not grant TK/Maxim permission to operate at this site. There is now a 30-day appeal period.

I visited the area around noon and observed traffic for a half hour. The wind was from the west at 5 mph and there had been no significant rainfall recently. I only saw one car and one pickup enter/exit the site, and I observed no fugitive dust. The entrance road back to the piles of concrete appeared to be well-treated with calcium chloride. It was hard-packed in most places. There was a little gravel that had trailed out onto the street.

I talked to Jenny Sopher on-site. She told me that concrete was no longer being hauled into the site and that all ground concrete had been removed. All that remained were unprocessed concrete and soil piles. I confirmed this. Jenny did say that some soil is brought in to the site on occasion.

Jenny showed me her records of dust control applications (Jerico invoices). They showed that 200 gallons were applied in June, 1100 in July, and 500 gallons on August 20th. She also had a record showing the street was swept in July.

I suggested that apply water to the treated areas if dust is being generated and to sweep the street more frequently.
